In MD, what happens when your employer cuts off your draw? Can you quit and file unemployment??r=1244509205?
I am a New Home sales rep and when I originally started my job we were paid a draw up to 75% of all of our commission, contingent and non-contingent. Now we are only allowed to draw against non-contingent commissions and only up to 50%. My draw is about to be cut if I don't make a non-contingent sale this month. With the current housing market, this doesn't look possible. Does my employer have to lay me off or can I quit under MD guidelines and still file for unemployment? There are a handful of other reps in my same position and we are eagerly awaiting an answer from corporate. What are our rights as commission/draw paid employees?
