Separation of church and state?

The first amendment protects the citizens from having to deal with this problem. The constitution is in the eye of the beholder. In the United States the government recognizes marriages by law. Marriage is a religious institute, but if noone challenges it, then it is not unconstitutional. So, it's all about who views the constitution.
